Welcome to the Swiing website operated by Team Moxim Sdn Bhd, registered in Malaysia. By accessing or using our website, placing an order, or creating an account, you agree to these Terms & Conditions.

1. Who We Are

Swiiing creates personality-packed protection for the pickleball court. Our signature designs, including the Swiggle Paddle Guard, combine bold aesthetics with durable performance.

2. Eligibility and Acceptable Use

  • We do our best to display product colours, sizing, and specifications accurately. Actual colours or finishes may vary by screen and batch.

  • Minor design updates or material improvements may occur without prior notice.

  • All products are subject to availability. We may limit quantities and refuse or cancel orders at our discretion.

 

5. Specialty Disclaimer: Edge Guards and Adhesive Products

  • Installation: Follow the instructions included with the product and any videos on our site. Improper installation can affect adhesion and paddle performance

  • Compatibility: Our guards and tapes are designed to fit a wide range of pickleball paddles, but not all. Check measurements and shape before purchase.

  • Surfaces/Finishes: Adhesives may not bond well to certain coatings or heavily textured rims, and removal can leave residue or mark surfaces. Test on a small, inconspicuous area when possible.

  • Care: Avoid solvents, extreme heat, and prolonged water exposure. Inspect regularly and replace if worn or lifting.

  • Safety: Sports involve inherent risks. Use products responsibly and discontinue use if damaged. By using our products, you acknowledge and accept these risks.

 

6. Pricing, Payments, and Taxes

  • Prices are listed in MYR and exclude/include taxes as stated at checkout.

  • We accept the payment methods shown at checkout. By submitting a payment, you confirm you’re authorised to use that method.

  • If a pricing or availability error occurs, we may cancel the order and refund any amount paid.

  • For international orders, you are responsible for any customs, duties, or import fees.

 

7. Orders, Shipping, and Delivery

  • Order acceptance occurs when we send a shipping confirmation.

  • Shipping options, fees, and estimated delivery times are shown at checkout. Estimates are not guarantees and may be affected by carrier delays, customs, or events beyond our control.

  • Risk of loss transfers to you upon delivery to the carrier for international shipments and upon delivery to your address for domestic shipments unless local law provides otherwise.

  • Please provide accurate shipping details. We are not responsible for non-delivery due to incorrect addresses or uncollected parcels.

 

8. Returns, Exchanges, and Refunds

  • We accept returns for unused, unopened products in original packaging within 14 days of delivery, unless marked final sale.

  • For hygiene and performance reasons, used adhesive products or items that have been installed cannot be returned unless defective under warranty.

  • To start a return, contact us at [support email] with your order number and reason. Unauthorised returns may be refused.

  • Refunds are issued to the original payment method, minus shipping and applicable fees, after inspection.

  • If you receive a damaged or incorrect item, contact us within 3 days of delivery with photos so we can make it right.

 

9. Limited Warranty

  • We warrant that products will be free from manufacturing defects in materials and workmanship for 7 days from delivery.

  • This warranty does not cover normal wear and tear, misuse, improper installation, exposure to extreme conditions, or modifications.

  • Our obligation is limited to repair, replacement, or refund at our discretion.

10. Promotions and Gift Cards

  • Promotions, discount codes, and offers are subject to separate terms and may not be combined.

  • We may modify or withdraw promotions at any time.

  • Gift cards are non-refundable and cannot be exchanged for cash except where required by law.

 

11. Intellectual Property

  • All content on this site, including the Swiiing name, logos, product names such as “Swiggle Paddle Guard,” designs, photographs, graphics, text, and code, are owned by or licensed to us and are protected by intellectual property laws.

  • You may link to our homepage in a fair and legal way that does not damage our reputation or suggest endorsement.

  • Disputes: Parties will first attempt to resolve disputes informally within 30 days. If unresolved, disputes will be submitted to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.

  • Consumers in other jurisdictions may have additional rights under local laws. Nothing in these Terms limits those rights where they apply.

 

21. Force Majeure

We will not be liable for any delay or failure to perform due to events beyond our reasonable control, including acts of God, extreme weather, pandemics, labour disputes, war, terrorism, embargoes, government actions, carrier or supplier failures, or internet/service interruptions.

If any provision is found unenforceable, it will be severed and the remaining provisions remain in effect. You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights and obligations in connection with a merger, acquisition, asset sale, or by operation of law.

These Terms, together with our Privacy Policy, Cookie Policy, and any additional terms presented at the point of sale, constitute the entire agreement between you and us regarding the site and products.
